Protected Trees

What is considered a protected tree?

(1) ANY tree over 80cm DBH

(2) Some native tree species are protected earlier in life, see the two special categories below:

(a) Tree with diameter  greater than 10cm measured at  grade OR  greater than 5m in total height:
(i) Garry oak
(ii) Arbutus
(iii) Pacific Dogwood
(iv) Pacific Yew

(v) Cascara

Tree with DBH  greater than 60cm:

(i) Douglas-fir

(3) ANY tree located on municipal property

(4) Wildlife tree (must have visible nest of raptor, osprey, or heron)

If you’re a property developer in Victoria, understanding which trees are protected can save you time and legal trouble. Protected trees, such as Garry oaks and Pacific dogwoods, fall under specific regulations that ensure their preservation.

How do I measure the DBH of my tree?

Measure the diameter of the tree at 1.4m (4ft, 7-inches) off the ground. If the tree is on a slope, measure from the highest point of natural grade around the tree. 

Diameter can be found by measuring the circumference at this point and dividing by pi (3.14)

How do I calculate the DBH of my tree if it is multi-stem?

The DBH of a Protected Tree having multiple trunks shall be determined by measuring all the trunks and adding them together. Each trunk diameter should be measured at 1.4 meters above the ground and is determined by the sum: 

(i) One hundred (100%) percent of the DBH of the largest trunk; and 

(ii) Sixty percent (60%) of the DBH of each additional trunk.

Permits

Do I need a permit?

A permit is required when you wish to:

  1. Remove a protected tree or 
  2. Remove any tree within 10 meters of any other lot line
  3. Within 20 meters of any lot line adjacent to or abutting a highway or road, or trail, right-of-way

Removing trees near your property requires careful planning. If your protected tree is close to a house or structure, specific bylaws may apply to ensure safety and compliance.

How much does a permit cost?
Tree Pruning

Highlands does not have permits for pruning. Pruning techniques play a key role in maintaining tree health and structure. Even though Highlands doesn’t issue permits for pruning, following proper pruning practices ensures the longevity of your trees.

Tree Removal

There is a fee of $25 per 50 trees to be removed

Replacement Trees

What are the replacement tree requirements?

Highlands does not require replacement trees unless a protected tree has been removed without a permit
